St. Petersburg Improper Exhibition of a Firearm Attorney
Improper exhibition of a Firearm and/or Improper Display of a Weapon are crimes governed by Florida Statute 790.10. The offense roots from the common law crime of brandishing. Improper Exhibition of a Firearm is usually applied as a reduced offense of aggravated assault, and premises the option of an aggravated assault being “plea bargained” down to this “lesser” criminal offense. Improper Exhibition of a Firearm can also be charged because a person displayed a firearm so hastily that other persons in the vicinity believed they might get accidentally targeted, or because a person displayed a weapon in a manner that was transparently offensive to most reasonable people.
When defending this form of criminal offense you should know that whether you infringe on Florida’s law or not, charges will be determined by an “objective” origin rather a “subjective” origin. The “objective” origin encompasses the circumstance of viewing your actions with the firearm reflecting such exhibition as being done in an irrationally attacking manner, or being done in a way that generates an unreasonable risk of injury to other individuals or assets. Unless your circumstances occurred in these manners, there is not a basis of an established criminal offense.

§790.10 Improper exhibition of dangerous weapons or firearms.–
If any person having or carrying any dirk, sword, sword cane, firearm, electric weapon or device, or another weapon shall, in the presence of one or more persons, exhibit the same in a rude, careless, angry, or threatening manner, not in necessary self-defense, the person so offending shall be guilty of a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083.
